The amended complaint alleges that defendants, officers and directors of the Company, issued materially false and misleading statements and/or omitted material information concerning the true prospects and safety risks of the Company's lead drug candidate – HEPLISAV-B – from approximately April 26, 2012 to November 14, 2016, and that the Company's internal controls over financial reporting are inadequate and deficient. 

On June 7, 2017, the plaintiff in Carol Truglio v. Arnold Oronsky, et al., Case No. RG13686266, a separate derivative case purportedly filed on behalf of Dynavax on July 3, 2013, in the Superior Court of the State of California, Alameda County ("Truglio"), filed a Stipulation of Settlement dated May 19, 2017 (the "Settlement").  On August 8, 2017, Plaintiff in Truglio will be moving for entry of the Proposed Preliminary Approval Order which amongst other things grants preliminary approval of the Settlement.  The relevant time period described in the Settlement is between April 2012 and approximately July 2013.
